Terms & Conditions
1. Contracting Partners
1.1 Perfect Contours Kft.
Perfect Contours Kft. is an agent enterprise registered in Hungary by the Municipal Court under Reg. No. 01-09-870996 , in form of a Company of Limited Liability, residing at 1028 Budapest, Kõvári u.1, Hungary . (- hereinafter Agent ). In connection to present Contract all Members of the Company are entitled by the Director to act and sign for the Company with full legal force.
1.2 Client
The Person will be regarded to as Client who signed the present Contract as written hereinafter or transferred the administration fee to Perfect Contours Kft.
2. Concluding Contract
2.1 General Contract
Contractual Partners agree that present document is to be accepted as signed by Perfect Contours Kft. in relation to all general conditions – excluding however assumed consent regarding individual circumstances and demands of the Client. Information published at the date of Acceptance (Point 2.2) on the official homepage of Perfect Contours Kft. is to be regarded as part of the Contract accepted by the Client.
2.2 Acceptance by Client
Contractual Partners agree, that 1 deviating from possible regulations of international law regarding the way of signing a contract abroad, and acceptance of international trade – present contract can be signed without additional formalities (no witnesses, counter signature or notary authorisation of contract is needed).
Acceptance of the contract by the Client will set forthwith on date
1 the contract is signed by the Client and received by the Agent or 2 the transfer of Administration Fee is credited to the Agent’s Account.
2.3 Deviation & change of Contractual Conditions
Any deviation, modification or change of provisions of present Contract can only be agreed in writing in individual conditions, and duly signed by both parties.
2.4 Interpretation
2.4.1 Agency
Perfect Contours Kft. is acting here only as agent between the patient and the selected clinic and surgeon.
It’s to be made clear that the present Contract bears the legal character of an agents’ contract in the sense of §§. 474 – 487 of the Hungarian Civil Code.
2.4.2 Hungarian Legal Interpretation
Conditions of present Contract have to be understood as interpreted by the Hungarian Legislation.
2.4.3 Common Sence (Ideas, expressions, behaviour and measures of the Partners – no legal interpretation existing supposed,– are to be interpreted according to common sence of the words and gestures.)
3. Subject of the Contract
Perfect Contours Kft. assists the Client as an Agent to arrange contact and agreement between the patient and the selected clinic and surgeon. Perfect Contours Kft. assists the Client with airport pick up, accommodation and entertainment (such as sightseeing) if required. Perfect Contours Kft. will not enter into agreement as representative of the Client with a third party.
4. Expositions
Any information published by the Agent regarding the clinic, surgeons, operations, operational risks, duration of treatment and prices are based upon up- to-date information as provided by the clinic or surgeons. All information published by the Agent related to travel, transfer, local events, accomodation and costs are based on publicly available sources. All proposals for booking of transfer, accommodation and entertainment made by the Agent are based on preliminary agreements with the according enterprises.
5. Agent’s Obligations
Perfect Contours Kft. will – after signature of Contract ( P. 2.2. ) – send a medical questionnaire to the Client asking for a full medical check up. Perfect Contours Kft. will – after receiving report of the Client’s full medical check up – contact the proposed Clinic giving the data of the Client. After contacting the clinic the Agent will propose a date and final cost of the required surgery to the Client. If required the Agent will arrange airport pick up and entertainment possibilities for the Client for the duration of his/her stay in Budapest.
6. Clients Obligations
The Client is aware of the fact that organizing his/her treatment can start only after having sent a report of his/her full medical check up. In the event that the medical examination in Hungary shows that the patient cannot be operated on for medical reasons, neither Perfect Contours KFT nor the clinic or surgeon is responsible for any of the patient’s costs. The clinic or the Client’s surgeon will advise the Client in all aspects of the procedure including the very important area of after care. It is very important to understand that should the Client decide not to follow this advice the Client alone is responsible for the consequences of not doing so and for any repercussions that may occur. Quotes for procedures do not take into account any extra expense in the event of any unforeseen complication or for the need to extend the patients stay in hospital or in Hungary. All questions – especially those involving health and medical – have to be decided and declared by the Client personally.
7. Assistance Fee
Upon signature of this agreement the patient is required to transfer EUR 200 to Perfect Contours Kft., Account number, IBAN, SWIFT as an administration fee. This contract only comes into force once Perfect Contours Kft. is in receipt of the aforementioned amount. The transfer has to be received by Perfect Contours Kft. at least 14 days before the planned procedure. The administrative fee is non refundable. In the event that the patient has to delay the operation for whatever reason, the fee will apply toward the postponed operation as long as that takes place within 60 days from the date of the original procedure. Should the medical examination in Hungary show that the patient cannot be operated on for medical reasons, neither Perfect Contours KFT nor the clinic or surgeon is responsible for any of the patient’s costs.
8. Privacy
Perfect Contours Kft acknowledges that any data received in relation to present contract will be treated with the utmost discretion and in absolute confidence and will only be shared with the clinic/surgeon. The Client agrees that no information on his/her treatment and any other arrangements made by Perfect Contours Kft. will be passed on to a third party.
9. Liabilities.
The Agent as intermediate is by no means liable for any impossibility, failure or fault of medical services or after care; impossibility, failure or fault of other service or events proposed to the Client in the event of any medical dispute, this must be settled between the patient and the clinic / surgeon directly in accordance with Hungarian medical practice law. Perfect Contours Kft. cannot become involved in any such dispute nor for any complaint in respect of medical procedures and facilities.
10. Jurisdiction
10.1 Governing Law
Any disputes under the present contract or contracts and services emerging from the relations intermediated by the Agent will be ruled by Hungarian Law.
10.2 Jurisdiction
Should any dispute arise in respect of the present Contract legal proceedings will be judged exclusivly by the Municipal Court in Hungary, in usual legal process.
